Monday | July 01, 2002 Judge: death penalty is unconstitutional A federal district court judge has ruled the federal death penalty is unconstitutional. Next up is the the 2nd Circuit Court of Appeals, which covers NY, CT, and VT. While this news story is short on detail, it seems the judge used the Due Process clause to invalidate capital punishment (as opposed to the prohibition on "cruel and unusual punishment").
